I came back by July 15th 2018 , left with 2 months of my max-cap. My clients are ready to file my visa, 2 questions 1. Can i apply a fresh H1B in the upcoming year, March 2019? 2. If no, is there anything i can do about it rather waiting for March 2020. Thanks, G Link to comment
JoeF Posted September 4, 2018 Report Share Posted September 4, 2018 You absolutely have to be abroad for at least a year before a new H1 petition in the quota can be FILED. If you left the US on July 15, 2018, a new H1 petition can be filed by July 16, 2019. If the quota is full by then, a new petition can be filed April 1, 2020. Link to comment

I was looking around USCIS site extensively to get the point you mentioned but could not figure it out. Did you find the point mentioned somewhere? Also if that is the case other than that do i have any other option to enter by July 2019. Link to comment
JoeF Posted September 5, 2018 Report Share Posted September 5, 2018 It is in the law at 8 CFR 214.2(h) If you have an approved I-140 you can get H1 extensions past 6 years. Link to comment
