ark522 Posted July 20, 2018 Report Share Posted July 20, 2018 Hello, My present employer is sponsoring my H-1B. My previous employer had filed for my Green Card in 2012. I had switched over to the current employer in 2013. I have an approved I-140 but my previous employer withdrew it recently after more than 180 days of approval. As per the Jan 2017 portability rule, am I still eligible to apply for my H-1B visa extension with my present employer which is due to expire in Feb 2019? I would appreciate your advice. gouthamsworld Posted July 21, 2018 Report Share Posted July 21, 2018 Under the AC21 rule you can only port the PRiority Date. You can not use a revoked I140 for H1b Extensions. Link to comment
