vmallaid Posted July 16, 2018 Report Share Posted July 16, 2018 Hi, Below is my situation. I applied for a change of employer A an extension of my H1B in Jan 2018 in premium processing an got an RFE. I had time till April 2018 and submitte the RFE response for Employee Employer relationship and Specialty Occupation . However, after submitting the RFE response the H1B transfer was denied by the end of April 2018. My I94 was valid till June 04 , 2018 . and my previous H1B I797 was valid till May 25, 2018. the Employer A has again filed another H1B transfer an extension on May 09th 2018 for the same client and i am currently on a receipt number. Please let me know if i am legally allowed to stay for 240 days. June 4th 2018 - Feb 4th 2019. If the current petition that has been refiled will be denied again, will i accrue unlawful presence in the country , staying for more than 60 days. please let me know Link to comment
