Roh11 Posted June 26, 2018 Report Share Posted June 26, 2018 Hi, My H1b extension was denied earlier this month. Current H1B expiry is on August 1 and I94 expiry is on 8/11/2018. A few questions in this regard - 1. Company policy is to refile in premium but I was think regular might help since I have more time to prepare for a possible departure. Any cons to filing in regular processing? 2. I'm interviewing with other company (Company B). Assuming my existing company doesn't refile. If B files for my transfer before i94 expiry date can I still stay in the US legally until I hear back from USCIS? 3. Assuming my existing company has refiled H1B extension and it's still in progress, If B files for a H1B transfer after i94 expiration date can I still stay in the US legally? 4. How long can I stay after i94 expiry? I have an approved i140 if it helps. Regards Link to comment
