Question about H1B -> H4 -> H1B?

I recently got laid off on H1B which was approved for one year until November. I am trying to look for a new job in the 60 days I have. If I am unable to find a new job I plan to get married to my girlfriend who is already on H1B in the USA. I can come back on H4 and look for work. If a new employer files H1B for me, I won't need to go in the lottery right?

Will the time I used on H4 count towards the 6 year limit on H visas? 

Would I be breaking any laws by doing this?
