I had a DUI back in 2005, where I was detained in custody for a couple of hrs for fingerprinting and other documentation. I will answer yes to questions 22-27, but what about 28 A and B, which asks about "have you been to Jail or prison"? Anyone who can shed light on this would be great. Link to comment
natan111 Posted June 18, 2018 Report Share Posted June 18, 2018 Have you been to jail or prison? It's that simple. If you were in jail for the DUI, answer "yes" and explain. Was it 1 hour, 2 hours, one night...? This was well outside of your statutory period so you'll be fine. However, if you answer "no" they can deny your N-400 based on misrepresentation. This is one of the easiest steps in the immigration process but they are looking for misrepresentations, especially for past arrests, because it makes it easy for them to deny you if you don't report them.
