Raja Moola Mahadevan Posted April 22, 2018 Report Share Posted April 22, 2018 My wife and daughter having valid H4 Visa which is expiring on June, 2018. They are in India now. I recently switched my company and they filed Visa transfer through regular process. So it will take 4 to 6 months to get the approval notice. My question is, are they still travel back to US with my existing employer H4 Visa? Link to comment

What if in similar cases the H1B holder cannot go for PP since he's on 60-day grace period and the transfer was applied for without client letter and in Consular processing? Can the H4 dependent still enter the US with the old visa (from ex-employer) during the time the transfer is under regular-processing? Thanks for your time. Link to comment

If the person has left the old employer, the person is not in H1 status. The person is legal while the petition is pending, but dependents can not enter on H4 during that time. Link to comment
