RaoS1
Hello, I had continuous residence for more than 5 years after getting green card. After more than 5 years, due to family emergency, I have to move to India and stay more than 1 year using reentry permit. Did I break the 5 year continuous residency due to this even though I stayed more than 5 years after getting GC before going to India? Please let me know if the continuous residence should be before filing for citizenship or it can be anytime after getting my Green Card? I was about to file for Citizenship, but due to family emergency, I had to apply reentry permit (option to pick it up in India due to time constraint) and went to India. What are my options? Can I come back to USA, wait for 90 days and apply for citizenship as I had continuous 5 years stay in the past or I am not eligible as I broke the continuity based on the recent stay? Thanks in advance for your help. Link to comment
JoeF
Yes, any stay abroad for a year or more resets the continuous residency requirement. All the requirements are for the last 5 years before applying for naturalization. Please see the information at the USCIS website. Link to comment
