RFE Denial

Hi 

 

My H1 extension got denied after the RFE response and my employer says he got a yellow slip which says I cannot re- appeal and my employer says there was no reason for denial . The status in USCiS has not changed 

In this situation can I reappeal my case . Can I apply my H4 COS and can I apply my H4 EAD in premium . Have you heard any hearing  on H4EAD process

H4 ead premium = n/a

Yes, you can apply H4 cos. Apply H4 ead as a regular process and wait for 3-4 months for ead approval. Right now the wait time is around 5-6 months

The H1 is the employer's petition. Only the employer could appeal a denial. There is no "yellow slip". The decision comes on a well-known form. There is always due process, so there is a 30-day period in which the decision can be appealed, maybe unless it is considered frivolous.
