newtogc
Hi List I have a valid I-140( has been active 180+ days) sponsored by my current employer and the current H1-B(6th year) has only 3 months left.My employer is not going to file a new 3 year H1-B so I've started interviewing for jobs. One of the recruiters mentioned that employers look for at least 6 moths remaining in the current H1-B for a sponsoring a new visa . I told him it doesn't really matter how much time is left in my current H1 as the new employer can get a new 3 year H1B. Am I right? Thanks for your time! Link to comment
NotAnAttorney
Yes, you are right, having an approved 140, you may get 3 years when new employer files for your petition. Link to comment
