isha123 Posted July 17, 2017 Report Share Posted July 17, 2017 My Employer has withdrawn my H1B petition without my consent due to some internal issues before approval of H1 (status of my case before withdrawal : RFE to be submitted). I have received mail from USCIS regarding Acknowledgement of Withdrawal request. Is there any possibility to reopen the case or revoke the withdrawal or filing new amendment without getting into Lottery of next Cap ?. Please share your experiences. Link to comment
JoeF Posted July 17, 2017 Report Share Posted July 17, 2017 The H1 is the employer's petition. The employer doesn't need your consent to withdraw it. The H1 is gone. A new employer can file an H1 for you in next year's quota. Link to comment
