Is there a threat of losing H1B status if one takes elongated time off from work (3-4 months) on the the American Disability Act? This is after the H1B visa holder has already exhausted their FMLA benefits. HR has said that they will forward the application to the insurance company but can the work place fire a foreign national because they are on disability leave? Thank you.

Thank you for your reply. Essentially it then means that one cannot fly out of the US even if the H1B is valid. I presume that the US Consulates are not even giving appointments for visa stamping anywhere.

How do the recent changes in immigration rules impact international travel for H1B holders? I need to travel outside the US for research and have a valid H1B visa (stamping expires in August 2020). Is it safe to travel? If I were to travel to India for visa stamping will there be problems reentering the US? Thank you.

I don't have a reply to your question but am puzzled that they allowed premium processing for your visa application because on March 20th, 2020 the USCIS temporarily suspended premium processing. Perhaps that is the reason why the decision on your case is taking so long. They are going to open premium processing on June 1st for some cases. Can you ask your attorney to verify and let us know here on the forum? Hello Forumites. Can anyone tell what the rules are to seek FMLA leave while the H1B extension processing is still on? I am on my second extension and due to covid it did not go through via premium processing. My application was filed in April and we have received the notification of receipt, It seems like the approval won't arrive for another 6 months. During this time can I go on an FMLA leave that might require traveling out of the US? Will it impact the extension process? Thank you. Stay safe and healthy in these crazy times.

I suddenly remember this: will the USCIS give an extension only until the validity of the passport? Mine expires in early 2021.
