  1. Hello, If a person A has Greencard but went back to India and did not come back to US for 2 years which can result in invalidation of the Greencard. In that case, if a person wants to come back to US, what are the options. Does the person has to go for a fresh H1B through lottery or is there a way to renew/re-activate the Greencard after 2 years of going back to India. Please provide the options. Thanks!
  2. Thanks for your response, Joe. One other question. When you mentioned the new employer can file a new H1 petition, does that mean they can file the H1 based on my approved I-140 or I have to go through a fresh H1 lottery. Thanks for your response.
  3. Hi Everyone, I have downgraded to EB3 last year and got my EAD approved. I am still on my H1b with the same employer and NOT yet used EAD. I just saw Feb Visa Bulletin and to my surprise EB2 dates have progressed to Jan 2013 where as EB3 is still at Jan 2012. My PD is Dec 2013. Q1: Do you anticipate the EB2 dates to further progress in the next few months, making my Dec 2013 PD current? Q2: If I stay with the same employer, am I eligible to use my EB2 instead of the downgraded EB3 and get the GC? (or) my EB2 is no longer available and I have to just rely on EB3? Q3: If I switch to a new employer, can I still use my EB2-EAD to get the GC or can I only use EB3 in that case. Thanks a ton in advance for your help here.
  4. Hi everyone, I have H1b & EAD from Company A and I am planning to join Company B using my EAD. Does using my EAD automatically de-activate my H1B status? What happens if I do not get EAD extension or the EAD extension is rejected for some reason in the next couple of years? In that event of EAD not getting approved/rejected, what are my chances of getting back to H1 Status and what is the process for that? I hope I still count towards the H1 Cap exempt. I wanted to be 100% sure before moving to the new company using my EAD and NOT H1B. Any help here is highly appreciated. Thanks in advance.
