498A/DV in India working in USA on H1B

I am from India. I got married to a girl from under Hindu marriage act in India. She messed up my life and was a totally different person before and after marriage. Constantly lying and demanding for money right from the beginning and threatening to file cases against me if I don't give her the money and buy things she need. She abandoned me many times and left to India at her will and come and go at her wish and threatens me of 498a and DV. Guys I have seen a lot you suffer similar with that laws in India. I am currently in USA and working and in the process of getting my GC. I am really new to this harassment and don't even know where to start and what precautions I should be taking. I tried to ask many lawyers here but every where I go they try to steal money from me. I am not financially sound and came here to work and provide better life for my future. I know that it is big ask for you guys but if any one who faced a similar situation like me before can please share there experiences and suggest me how they came out of this extortion of 498a and dv cases that would be really grateful. My Questions

 

1) How to protect my elderly and sick parents who are in India from getting arrested

2)How to protect my brother and sister who works in USA as my wife may add them in the case.

3)What should be my steps during this process. How can I protect my H1B, my job and get my GC in 1-2 years(waiting for priority date) without messing my Visa status.

4) Is it recommended to stay in USA during these times or go to India and fight there

5)What evidence can I use in the court of law in India to prove that she is lying.

 

Any responses to this is greatly helpful. If any one who faced similar situation would communicate with me through email or call me also I would be grateful to them. Please helpout a fellow brother.

Dude, before she files a case. Go to your home country, file a divorce and come back to start a new life. It takes time and money, but you need to have patience her since the law is very much helping her.

Laws are so strict here, if you have case in India and you applying for extension, you don't even get extension of visa. 

 

In Murthy firm I read similar case where the guy visited wedding of his cousin brother, he just saw his cousin brother wife only once, and when she did file the false case, she also included the guy in case as he also harassed,his visa extension rejected because of this and he has to prove his trust worthy saying he not even met her after marriage. and he has to spend lot of money apponting attorney and all for this. 

 

Here he is just some cousin distinct relative, imagine you are directly related. 

 

Again India law is very strict but its better this matter smoothly as much as you can and let this dust settle down. 

 

Sadly somethings cant be proved, if she says he is mentally torchering, what proof you can show that you are not? 

 

as of now honestly nothing you can do rather than settling down and also contact indian lawyers, they are CHEAP to settle case in India.

not true that if you have 498a pending against you, your immigrant life is over...it has been brought to the attention of indian supreme court and USCIS they know it..

 

ya..but corrupt police in india can make ur family's life there miserable with bribe demands..so better  get a lawyer in India and get it settled for once and all with mutual agreement with wife and reasonable compensation so that you can move on with your rest of life peacefully..
