johija
I have a valid VISA till Aug 2016. I moved to a different location for the the same employer after and I have a new LCA for that as well. After the new ruling, my employer filed an Amendment and I got the receipt number. I have 2 questions: 1. Can I travel to India and come back in 2 weeks, while my amendment is still in progress 2. If my amendment is approved before I travel / while I'm in India, do I need to go for stamping before coming to the US Link to comment
jairichi
1. You cannot enter without amendment approval. 2. Not required. Link to comment
johija
Thanks Jairichi. I heard that the USCIS sent a clarification that amendment is not required if you moved to a different location before April. My new LCA was certified in August 2014 (which is when I came to the US). If that message from USCIS is correct, then I shouldn't even have to file an amendment. So, can't I just use my existing petition and VISA stamping? Link to comment
