COS - L1 B to H1

Hi All,

 

Please advice on the current scenario:

 

• I'm currently on L1 B (Visa expired, I-94 valid till Jan 2016) with X company.
• H1 got picked in Lottery with Y company and is currently "case received" status.
• My current project with X company is complete and they want to be travel back to India mostly by 10th Aug.
• Will there be any grace period that I can quit X company and stay back in US to start working on H1 from Oct 1 with Y company ?
• If Yes, what is the grace period,(concern from now to Sept 30).
• Will there be any issues with the H1 as I will be travelling when the COS is in progress and H1 is not approved yet.
• Can I move my H1 petition to "Premium" now?

Zero days grace period. You need to exit US after last day with employer. Enter US with a valid H1B visa and I797 not more than 10 days before H1B start date.
