On L1A - What if company fires me?

Hi All

 

I am currently working on L1A and hearing lot of layoff news in the company.

1. Can a company fire you/lay you off when on L1A? 

2. Do they need to give me a return ticket to my home country in India?

3. Is there any law protecting those from firing?

4. What rights i have to reappeal this case?

 

On the other hand

 

1. Is that possible for me to find another job who will sponsor me a visa?

Sure the company can fire a person at any time. Employment in the US is "at will", meaning that both sides can terminate the employment relationship at any time.

The L1 has less protections than the H1. You have to leave the country, but the company doesn't have to give you any ticket or anything else.

 

For another job, you would have to get an appropriate sponsorship. The H1 quota is full, so no H1 is possible until next year. And an L1 for another company requires that you worked for the company abroad for at least a year in the previous 3 years.

There is probably no other way than to return to your home country if you get laid off.

I worked for "company A" in India and left in March , 2015 . I have two queries here :

 

1. If I join "company A"  in India in June , 2015  , Will I be able to apply for L1B immediately once I join ?

 

2. Can I apply for a job in USA in the same  " company  A "  directly without currently being an employee in India .
