rajans4u Posted February 27, 2015 Report Share Posted February 27, 2015 Hello! I entered the US first in 2011 (October) on an industrial H1B issued by a consulting company. In Sept 2013, I took up full time employment with a University, which falls under the non profit category. My current I-797 has the University as the petitioner. I now have a job offer from a consulting company which is willing to do my h1 transfer. I have tried to research the internet and hear conflicting versions on the topic of h1b transfer. Some say that since I was already counted against the CAP, I would not have issues transferring from non-profit to industry, but others say that I would have to apply for a fresh H1-B in April and wait for 6 months before I can start working. JoeF Posted February 28, 2015 Report Share Posted February 28, 2015 Once you have been counted for the quota, you are not counted again unless you have used the full 6 years, and you can switch freely between for-profit and non-profit organizations. Link to comment
