EB2 Eligibility within current Employer

Hi Everyone,

 

I have 4 years of experience from my previous employer and now I have completed 1 year with my current employer.

 

My current employer is ready to file a Green card for me in EB2 but as I should have min 5 years of experience for EB2 prior to current employer.

 

So I am left with 2 options :

1) they can file in EB3

2) they can changes my roles and responsibilities by 50% and still file in EB2

 

So my question is regarding the 2nd option, when that change or promotion should apply ?

 

before they start the process

before/after labour

after/before 140 

 

Please let me know if there is other best option to apply in EB2.

For now go for EB3 and get your PD later port to EB2, if you wait till you are eligible for EB2 then your PD will be next year.

They can changes my roles and responsibilities by 50% and still file in EB2 - this option is available for someone who already have EB3 I-140 approved with the same employer.
