Multiple I 140 petitions

Hello Sir/Madam,

 

My I140 under category EB3 was approved with company A, PD jan 2009. I moved to company B due to personal reasons, and b'coz company A refused to share the I140 approval reciept number company B applied for fresh I 140 under category EB2,got approved with PD Oct 2012.

However, i recently recieved my old I140 approval reciept number from company A and curious to know if i can still use the priority date some how which is jan 2009 ( current ).. What are my options ? like can i use old PD with my current I 140 approval (EB2 ) or apply for another fresh petition using the old PD ?

Yes, you can use the old PD.

you have to request USCIS to port old priority date by sending letter with your I-140s ( Old & new ) and I-485 notice copy.

Check A# numbers in both I-140s, A# should be same in both, otherwise you have request USCIS to consolidate A#
