do I need a j1 waiver

I had a H1B visa until September 30, 2013 which completed 3years on H1B status. Then I returned to India. Now I am going for 3 months to USA on a J1 short-term scholar visa. If now I get a job who are willing to sponsor my H1B, would I be subject to the 2-year home residency requirement, considering I had H1B from before? Will I have to get a new H1B or extend the old H1B?

Please do not take J1 visa if it is ONLY for 3 months.....you will have to get the J1 waiver before you can get another H1 (this will take about 8-10 months to get).....stay away from J1 as much as u can...all the best...

Your previous H1B has no bearing on a HRR.  Why would it?
