I'm on my 7th year on H1B with I140 approved and priority date is Oct 2010 with Company A. I got a better offer from company B. They will start my GC work only after 6 months of joining and they are okay to port the Priority date as well. My questions here are.. 1. Since the priority dates are moving fast, If my priority date becomes current while H1 transfer is in progress, will that cause any issue with my H1 transfer? 2. Company B will start my GC work only after 6 months and it may take a total of 1 year for them to file I140. Say If my priority date becomes current in a month or two, will there be any issue to port my priority date at that time and can company B file I485 at the same time? 3. Attorney_7 Posted January 16, 2012 Report Share Posted January 16, 2012 When extending H1B beyond the 6-year limitation, if the priority date is current at the time of filing, the Beneficiary is only eligible for a one-year extension at a time. Generally, I-485 may be submitted at any time the priority date is current. Link to comment
