skydelta Posted June 25, 2017 Report Share Posted June 25, 2017 I am on an E-1 (spouse) visa and hold an EAD which expires in 6 months. The requirements from E-1 visa holders are similar to L-2. According to a new USCIS rule that went into effect on Jan. 17 2017, EAD renewal applications will be permitted up to 180 days before expiration (see links below). Also, USCIS is no longer obliged to process EAD applications in under 90 days. However, according to "Ask Emma" on the USCIS website "You cannot file for a renewal of your EAD more than 120 days before your original EAD expires". In another page on the website - "Generally, you should not file for a renewal EAD more than 180 days before your original EAD expires". Which statement is correct? Has anyone tried to file an EAD renewal application 180 days before expiration?
