NewToGC3 Posted May 3, 2017 Report Share Posted May 3, 2017 Baby born in India while I485 was in progress, mother left to India due to family situations, now green card approved for both parents and received physical card. I am (father) planning to visit India and bring child with mother together, child is 5 months old now, mother is out of US appx 9 months (within 1 year range). Is baby automatically get green card while entering to US along with Mother? if not what is the process to bring baby to US? Thanks Link to comment
nagaraj001 Posted June 10, 2017 Report Share Posted June 10, 2017 Yes and following is helpful A child born abroad to parents who are U.S. Lawful Permanent Residents may enter the United States without a visa, provided the child is accompanied by a parent, upon that parent's first return to the United States within two years of the child's birth. The parent must provide reliable documentation showing the parent-child relationship. Link to comment
JoeF Posted June 10, 2017 Report Share Posted June 10, 2017 If the child was born before the mother's had a GC, you can NOT just travel to the US with the child. The child would have to get an immigrant visa through a follow-to-join process. Link to comment

So, the rule you quote does not apply here. The child needs to get an immigrant visa through follow-to-join. Link to comment
