KALA1321 Posted April 26, 2017 Report Share Posted April 26, 2017 Current Status 1) This is my 9th year in USA 2) Approved I-140 on July-2015 with priority date as OCT-2013 3) Current H1B with Company "X" and valid until July-2018 Question If i resign my job ( lets assume i am not terminated) Question-1) can i get 60 days grace period ? Question-2) If i move to H4 ( Spouse having valid H1B) , can i transfer my H1B to any employer before July-2018? ( Note the current employer will terminate H1B as soon i resign) Link to comment
Attorney_15 Posted April 30, 2017 Report Share Posted April 30, 2017 The 60 day grace period, DHS stated, is for a circumstance when a person is terminated. USCIS does ask in RFEs when a person's employment actually ended and so attempting to push a more novel and not intended interpretation of the law comes with considerable risk. Link to comment
