My Perm and I140 is approved. I know if I switch employer then they have to again file for perm and i140 but my priority date will remain same. I wanted to know if I want to switch employer after 180 days of I140 approval 1. Can I switch from Non profit to profit organizations? 2. If yes, do my new employer has to just file for my H1b extension or my application will go into cap exempt H1b lottery? 3. If my H1B application has to go thru lottery and it wasn't selected what are my options? Any help will be appreciated. Thanks. Link to comment
JoeF Posted April 8, 2017 Report Share Posted April 8, 2017 If you have not been counted in the H1 quota, a petition from a non-cap-exempt employer can only be filed in the quota. It doesn't matter if you have an I-140 or not. Link to comment
