sanjay1984
Hi All My spouse and kid overstayed for 178 days beyond their i94 expiry date. This was due to our misunderstanding that employer would have filed extension for both me and my family. My extension had come through in Jan 2017, however we realized that their extension has not come through, on 10th March 2017, while I was preparing for tax return. They traveled back to India on 178th day (on 14th March) to avoid 3 year ban, and now I am planning for their visa stamping at Mumbai embassy. I have already initiated H4 stamping for family, and in the DS160 question about the overstay, we mentioned "YES" in order not to hide any thing. Based on my case, can someone please help me get anwser to the below queries: Hope this will not go against my spouse's h4 stamping. 1. Does this have impact on my wife's stamping approval? 4. In this situation, does it makes any difference whether my wife and kid go for stamping by their own, or should I travel back to India to accompany them for stamping? Please share if you have faced similar issue, or know about someone who went through this experience. Thanks Sanjay Link to comment
