Volunteer work in India while being on H-4 visa in USA
JoeF replied to Shiwanjalit's topic in H1B : H-4 Issues
Volunteering would only be possible if everybody in a similar position is volunteering. -
That university is a public university, so everything they do is financed by the State of Kansas, i.e., the state government.

Do you or your employer have a lawyer? If not, get one. -
H4 visa stamping expired and have valid ead till 2026
JoeF replied to poornima12's topic in Student Visas
The visa stamp is irrelevant while in the US. In the US, the date on the I-94 matters. -
Does the naturalization certificate show your new last name? Was this a court ceremony with a judge? Name changes require a court session, with a judge presiding. If this was a court session and your new name is on the certificate you should have gotten a document about the name change.

25 yes, 26 and 27 no. In the Additional Information space, write something like "speeding tickets."

H4 I94 Date issued with New H1B I797 while Entering USA
JoeF replied to GANM's topic in H1B : I-94 Cards
No. In the US, the visa date is irrelevant. The date on the I-94 is what counts. -

Hi I am on L1A and my I140 is approved since Feb 2023. In case i have to change the employer since i meet the 180 day rule, will I be able to port my L1A and I-140 to my new employer? Will my new employer has to file these docs with USIC.
JoeF replied to HMalik's topic in Employment Based Interviews
An I-140 is never ported. The new employer would have to start the process from scratch. You can keep the PD, though. -
The AP is invalid now. You need the GC.
-
Consult an immigration lawyer.
-
Hmm, your post is not very clear. EB2 is a path to a Green card, once you have the GC how you got there is pretty much irrelevant. It is not clear if you actually have a GC, then EB2 or EB3 are irrelevant, or if you are still in the process of getting a GC. If you have a GC the company can not do anything to it.

AVR dies not work with visa stamping.

JoeF replied to newuser21's topic in Family & Employment-Based Green Card : General
Once you have the GC your spouse's H4 becomes invalid. -
i485 for mother
JoeF replied to sarah george's topic in Family & Employment-Based Green Card : General
An I-130 and I-485 can be filed. Note that once the GC is approved she has to live in the US. -
An I-140 doesn't transfer to a new employer. The new employer would have to start the process over from scratch. The only thing that you can keep is the priority date from the old I-140.
-
Did you get paid? The IRS has a form on their website to report if you didn't get a W2. They will then contact the employer.
-
A company cannot request payment for the H1. That's in the law.

I sold liquor to under age age and cop gave me a yellow ticket
JoeF replied to ranveer sing's topic in H1B : General
Nobody is going to believe this "just for replacement". No store owner hands over the cash register to some arbitrary person. You worked without authorization, most likely regularly. That of course comes back to bite you. Seek the help of an immigration lawyer. -
Bring family to USA. They already have green card
JoeF replied to patas's topic in Application Process
If they stayed abroad for more than a year their GCs are invalid and can not be used. You would have to file for new GCs for them, form I-130 with Consular Processing. -
No issue. Your spouse's H4 doesn't depend on an employer, it depends on your H1.
-
You would have to live with the child abroad for a year before the child could get a dependent visa. See https://travel.state.gov/content/travel/en/Intercountry-Adoption/Adoption-Process/before-you-adopt/adoption-by-non-us-citizens-living-in-us.html

You absolutely have to be outside the country for a year before a new H1 in the lottery can be filed. And day 1 cpt is a bad idea to begin with. It will cause problems with getting an H1 later on.
