L1B to L1A reclassification case RFE

Hi,

 

Here is my situation -

 

1. 5 year of maximum stay on L1B visa is completing on 15th June 2016 and I-94 is expiring in Oct 2016.

2. Filed L1B to L1A reclassification case in premium processing in May 2016 and resulted in RFE in May 2016.

3. As per my company immigration attorney, I can stay in US after 15th June until the RFE is resolves or decision is taken by USCIS on my application for a period of 240 days.

4. My employer also filed for h1b fresh petition which is approved and that will come in effect from Oct 2016.

 

questions -

 

1. if I will stay in USA after 15th June will it be considered as overstay?

2. Can I wait until the RFE resolves?

3. if I will go out of US on 15th June, will it affect ongoing L1B to L1A reclassification case ?

4. if I will stay after 15th June and if my case rejects, will it affect the h1b stamping ?
