Porting EB3 Priority date to EB2

Recommended Posts

I started my GC in EB3 category in 2006 with a priority date of 30th Jun 2006. My I-140 was approved and I applied for I-485 in 2007 and since then I have been working on EAD.

I decided to port my EB3 priority date to EB2 and in the process my new employer did my PERM and my I-140 got approved 2 weeks back. However, just recently, the EB2 priority date got pushed back to 2004.

My attorney stated that when my date becomes current, I am not required to again apply for I-485 as I already have a pending I-485 that I applied in 2007.

My question is, since my new I-140 is approved, am I required to still continue employment with my new employer or can I switch employers? Will it affect my new approved I-140 or my I-485?

Also, will my old I-140 (which got approved thru EB3) still stay valid?
