krisc2499 Posted April 3, 2016 Report Share Posted April 3, 2016 Hi, My spouse got H1 and i am planning to go to US as dependent. I came to know that H1 dependent are eligible to work. May i know are there any conditions for H4 to work. If i am not eligible to work with H4 , do i have any other best option to get work permit after going to US as H4 (He Dependent). pontevecchio Posted April 4, 2016 Report Share Posted April 4, 2016 H4 dependents can only work if the H1 person has an approved Immigration Petition, I-140 and then after getting an EAD. You can try and get a H1 sponsor. Link to comment

Thank You Krishna An H1 can only be filed when the quota is open. The quota for fiscal year 2017 just started, and it is going to fill in the next couple of days. You won't be able to find an employer and get an H1 application in for the 2017 quota. So, you could try and find an employer to file a petition in April 2017 for a start date of Oct. 2017 (the beginning of the US 2018 fiscal year.) Link to comment

pontevecchio Posted April 6, 2016 Report Share Posted April 6, 2016 You can enter and once a H1 employer has filed a H1 petition for you and got it approved with Change of status from H4, you can start working. Obviously you need to first find an employer to file your H1. Link to comment

My doubt is (Since i was in H1 4 years back)- 1) Once i enter into US as H4 , do i have to wait for certain period to apply for H1? 2) If i want to apply for H1, will i fall under H1 quota (65000 quota)? 3) If i get H1 , should i have to wait until October(of the year i apply H1) to start working?
