Reclaiming unused H1B time

Hello,

 

I was on H1B status until May 2010 (worked for 4 years), and then started my PhD program. I am going to complete the program in June 2016, and then possibly go on OPT. Will I be able to reclaim the unused H1B time if an employer is willing to file it for me? Or do I have to go through the lottery as it's past 6 years time limit? 

I see conflicting answers online. If anyone has knowledge in this area, please advise.

You can claim two unused years of your previous H1B assuming you changed your status to F1 from May 2010.

You can claim 2 years of H1 time non cap at any time.
