Labor Applied on 20AUG2015 in Audit now

I am working for an India company A on H1B visa and completing 6 years stay in USA by 25-APR-2016. I have filed my Labor with out side company B (future based GC) on 21-AUG-2015.

 

I received response for Labor application on 01-MAR-2016 and it is in Audit now. Company B HR said it will take another 3-4 months to receive response on my audit. I would like to know if I am legal to work in USA after 25-APR-2015 if I join company B in USA. 

 

1. Any legal issues if I join company B in USA?

2. Is it good to go back India and return once my Labor or I140 approved completely?

3. Any challenges in my case?

1) no you cannot. your perm is not pending for more than 365 days.

 

2) yes.
