My spouse moved to the USA on a H4 visa mid 2015, and she has been on my employee sponsored medical insurance ever since. I am attempting to fill out my tax return forms, and one of the entries (11) has to do with whether the both of us (I am filing jointly for both) had a qualifying medical insurance through the whole of 2015. I did, she has had insurance since she moved here mid-year, and a state sponsored insurance from Europe where she lived before that. My question is, can I claim that both of us had a qualifying insurance through 2015, or will I have to pay a penalty (which seems rather unfair) because she has only had her insurance part year (since she moved).
