Guest
Hello This is my situation. Current H1B: Valid till June 21, 2016..stamping on passport done. I-140: Approved Future Plan: Apply for H1B extension: January 21, 2016 in premium. Is this ok as its 6 months ahead? Validity: Lets say I get 3 year extension which will be from June 21, 2016 to June 20, 2019 (a day or two +/-). I need to make a trip to India in March 2016. Technically I don't need to go to stamping as I have valid visa till June 21, 2016. But lets say I go for stamping and if its approved, all is good. For some reason if there is a RFE or rejection, can I still enter US with existing visa which is till June 2016? Please suggest. Thank you.. Link to comment
jairichi
An extension can be filed not more than 6 months earlier than petition expiry. Only if US consulate does not cancel your visa. Link to comment
