I-140 porting questions - plz read

Hi - one of my friend had  Oct 2010 as his Priority Date under EB2 with EMP A . Later he moved to EMP B , even though EMP B asked for porting of the  old PD , he did not get it on the I-140 Approval with EMP B ( 2 years later PD ) ..

 

EMP A  I-140 was not revoked with fraud , so it is valid for porting. But in this case did not happen ( not sure if USCIS mistake ) 

 

Is there something he can do now ? like asking USCIS to include the Old PD ..? 

 

any inputs will be helpful..

If employer A has revoked or withdrawn I-140 then PD cannot be ported. Check with an attorney.
