appdev
Hi All I have a question regarding I 140 portability issue. I am with Employer A who filed my I140. So I have my approved I140 with priority date in Aug 2012. I have already completed 5 years on my H1B. Now I got an opportunity with company B and they are ready to start my GC process as soon as I join the firm. But my current employer A informed me that we will revoke my current I140. Will I be able to port the I140 date from my old application in that case? In that case, if my new company B start GC process rite away, will there be any issue for my H1B extension? Please help me. ashuneel
You may not be able to port the date if I-140 is revoked. see article BIA Decision Brings Uncertainty to Priority Date Retention After I-140 Revocation No problem for H-1 extension. Link to comment
