appdev Posted December 5, 2015 Report Share Posted December 5, 2015 Hi All I have a question regarding I 140 portability issue. I am with Employer A who filed my I140. So I have my approved I140 with priority date in Aug 2012. I have already completed 5 years on my H1B. Now I got an opportunity with company B and they are ready to start my GC process as soon as I join the firm. But my current employer A informed me that we will revoke my current I140. Will I be able to port the I140 date from my old application in that case? In that case, if my new company B start GC process rite away, will there be any issue for my H1B extension? Please help me. balilanai Posted December 14, 2015 Report Share Posted December 14, 2015 To retain the priority date from employer A, they should not revoke your I-140. If you change jobs and employer A still revokes the I-140, you can start a new green card petition but you will lose your priority date. Link to comment
