RFE on H1 Transfer when extension is pending and I-94 expired

Hello,

 

I have been working with Company A for the past 5 years with an approved I-140 and I am done with my H1 7 yrs. For some reason my extension for H1 was pending from May 2015 and I-94 and Visa and latest H1 expired on July 31st. I have been working on receipt since then. I tried to transfer from Company A to Company B in October and I have received an RFE asking for the establishment of maintaining valid status from July 31st. by submitting the approval of Company A extension. Will I be able to steer clear off this situation? What should be next course of action. My company's attorney is looking into my case but I want to understand the complexity of my case and others opinion as well. Please advice.

Can you update what happened in above case? If approved did it came with I-94?
