My spouse is working on H1B based on the petition which is valid till Sep 2016. My spouse is currently having Stamped H4 visa. Question: 1. Will there be any issue if I get her EAD where as she has H1B valid petition. 2. I would like to have my Spouse work on EAD rather than H1B and if She works on EAD then will her H1B valid petition be stand null and void? 3. Again can Spouse come back to H1? Link to comment
jairichi Posted November 20, 2015 Report Share Posted November 20, 2015 1. She will not get EAD without moving to H4 status. 2. By law employer has to revoke that H1B petition once she leaves them. 3. Yes, if she has not used the maximum allowed stay of 6 years on H1B. Link to comment
