Indian Passport renewal in US with valid I797, but no visa stamp.

I am in the US right now, and my H1B visa(stamp) has expired. But I have applied for an extension and have a valid I797 for the next 3 years. Can I apply for a passport renewal to the Indian consulate with an expired US visa stamp? 

 

I ask since for persons without a valid US visa the Indian consulate asks them to get notarized documents form two Indians with approved green cards. In my situation the stamp has expired, but I am legally in the US, since my I797 is still current for 3 more years.

To clarify my question further: I need to know if I have to follow the requirement of getting two indians with green cards to vouch for my application. This seems pointless since I am here legally even though my visa stamp has expired. But I might be wrong. Kindly help..

According to BLS website you need to provide a notarised copy of your I797.

what you said is true. That doesn't make any sense, no need to get any notary from GC holders just send the application without those papers.You should get your PP.
