what is the Process to re-instate of my old H1B

Hi,

I am currently in US with L2 VISA working on w2 with x company.

My stay depends on L1 (my spouse)

L1 need to leave US on Dec 30th, So I also need to leave US on the same day as I am on L2.

I(L2) also have My old H1B VISA which was expired in sep, 2010, I did not travel to US During my H1B visa tenure to US.

Since my stay is dependent on my spouse stay(L1), I want to re-instate my old H1B.

could you let me know possible ways to do that and what are the chances to get H1B approval with re-instate of old H1B
