H1B-APPEAL Posted November 12, 2015 Report Share Posted November 12, 2015 This is with regards to Immigration on my H1B Visa. I have applied to transfer and extension of visa and it got denied Nov-03,2015 ,My employer is willing to appeal and the last date to appeal is Dec-03,2015 and my I-94 is expiring in Feb-20,2016. 1. Can I work with my employer till my I-94 expires and after it expires while appeal is pending ? 2. am I out of status if I am unable to apply for appeal due to unable to get the required documents to appeal or 3.Am I out of status If the appeal is rejected ? jairichi Posted November 13, 2015 Report Share Posted November 13, 2015 From the date of denial you have no authorisation to work. What you are doing is unauthorized employment. Filing a MTR does not allow you to stay in US. You should have exited US by now. Link to comment
