H1 B Paystub

Hi,

 

I am transferring my H1B to new employer. My old employer didn't run my last pay stub yet. I have asked my old employer to run my pay stub, but he is saying he cant run because he didn't get paid from client, he will pay once he receive it.

Can my old employer run my last paystub even after my H1 B transferred to new employer.

The employer getting paid by a client is irrelevant. You need to get paid. Period.

If the employer doesn't have the funds to pay his employees, he would have to declare bankruptcy.

File a complaint with DOL if the employer doesn't pay you on time.

Employer being paid by client or not is not your concern. He needs to pay you in time. If not file a complaint against employer with DOL. This will get your salary dues & smooth transfer to new employer.
