H1B Extension Processing, Can I Apply for H4 - EAD ?

Hello,

 

I applied for my h1b extension on July 2015, still waiting for approval.

 

and I got my I-140 approved on November 2015, applied on September 2015.

 

so is it ok to go ahead and apply for H4 - EAD for my wife ? or I have to wait until my H1B extension gets approved.

If your current H1B visa is mpt expired at the time of filing for your spouse's H4 EAD, it should work. The current processign times for H1 extension are highly delayed between May to September. So without premium processing, I do not expect your extension approval to come before December end.

I am in the same boat and ifnally had to opt for Premium processing
