During negotiations, they assured me premium processing. Now, when they are filing the petition, they claim that their funding situation has changed and can only do regular processing. Can I sue them? I rejected a lot of offers to take up this one and a lot of time was wasted during which I could have applied to other places. However there is no signed document establishing my accepting the offer conditional on premium processing, only email exchanges. Please help! Link to comment

wiweq Posted November 6, 2015 Report Share Posted November 6, 2015 As suggested multiple time, you shouldn't resign till next H1b is completely approve. Let them file in regular processing and wait for months for approval. Meanwhile find a better employer and tell the other employer that "things have been changed meanwhile". Link to comment
