kyat Posted October 2, 2015 Report Share Posted October 2, 2015 I recently received PERM approval and in the process of filing the I-140, but I am not sure under which category is my green card process being filed under. Can guys here help me if there is a place to look at on my PERM application to find out whether it is a EB2 application or a EB3 application I requested the lawyer handling the case and was said that they should not divulge the information since it will have an effect on the process. JoeF Posted October 5, 2015 Report Share Posted October 5, 2015 The employer files the I-140, and the employer and his lawyer know the category. A good employer would have told you, of course. If the employer doesn't tell you, you can only find out from the I-140 approval notice. Link to comment
Attorney_15 Posted October 19, 2015 Report Share Posted October 19, 2015 There is no place on the PERM application to check whether your case will be EB2 or EB3. These are USCIS terms and not DOL terms. The employer marks the box for EB2 or EB3 on the I140 petition form, and which box the employer can mark depends on what are the requirements for the job.
