NIW application in 8th year H1B extension on ex employe's I140

Changed to a new employer based on old employer's I140 & got 3 year H1B extension.

 

Current H1B expires in March 2017

 

Assume old employer withdraws I140 and new employer is unable to file PERM on time.

 

Can I get H1B extension of 1 year based on a pending (not approved) NIW or EB1A self petition?
