K2M Posted September 19, 2015 Report Posted September 19, 2015 I am in L1 visa and my wife is in L2 visa. My wife is working out side USA. She dont want to leave the current job untill she get work authorization in USA. Below are the queries. 1. Can my wife travel to USA and apply for EAD and return back while it is in processing ? 2. If no, then can she return back after getting EAD ? I mean will the EAD be valid if she travel out side country and return back. 3. What is approximate processing time for EAD ? Thanks in advance.

jairichi Posted September 22, 2015 Report Posted September 22, 2015 1. Yes. But for L2 EAD biometrics is involved (unless they changed that). 2. It will be valid. 3. 90 days according to USCIS website.
TTN Posted September 22, 2015 Report Posted September 22, 2015 1. Can my wife travel to USA and apply for EAD and return back while it is in processing ? >>> If no Biometric is required she should be fine to return back and then join once EAD is approved. 2. If no, then can she return back after getting EAD ? I mean will the EAD be valid if she travel out side country and return back. >>> EAD is given based on the I 94 and visa validity. After getting EAD a person can travel outside to their country. I do not think that is a problem. EAD is the permission to work in USA. 3. What is approximate processing time for EAD ? >>> Usually it takes 60 to 90 days to be complete. USCIS says that EAD process is complete within 90 days. Just my opinion and not Legal Advice Thanks, TTN
CG_NJ Posted September 28, 2015 Report Posted September 28, 2015 They need I-94 for your wife, hence she will have to visit US atleast once to get a I-94. You can apply for the EAD via post i.e. by sending in documents. Her physical presence will be needed for the biometrics as well. The EAD is issued within 60-90 days provided there is no query or request for additional documents. The EAd will be mailed to you and she does not have to physically present to recieve it. So that means, she needs to be in US for 2 purposes : 1. I-94 2. Biometrics Usually biometrics data is within 1 month of application of EAD, but it may depend on the center you are applying to and the city you are residing in.
