MyProfile4 Posted September 18, 2015 Report Posted September 18, 2015 Hi All, I got my H1B visa approved on September 15th in Vancouver and on the visa under Annotation there is a note saying "NOT VALID UNTIL 21-SEP-2015". Can I enter USA before that date? I have booked my flight for September 18th and not sure if I can fly then. The strange thing is that before getting this visa I already have H1B visa which is valid till end of this month which is September 30th, 2015 (I went to visa before expiration of my current H1B visa). But after my visa interview there is a stamp on that that H1B visa saying "CANCELLED WITHOUT PREJUDICE". Not sure if that is valid any more. Could anyone advice if I can enter before September 21st?

JoeF Posted September 18, 2015 Report Posted September 18, 2015 No, you can't. The H1 starts on Oct. 1, and you can enter up to 10 days earlier, hence the Sept. 21 annotation.
pizfor21 Posted September 18, 2015 Report Posted September 18, 2015 This looks scary to me as I am also planning to go for Visa renewal(Dec 2015) with my approved H1b extension much ahead than 90 days of new approved I-797(1st April 2016) start date and my current valid H1b visa expiring 03/31/2016? MyProfile4 Posted September 22, 2015 Author Report Posted September 22, 2015 You have to show both current I-797 and new I-797 that starts from 1st April 2016. Then the office will enter both petition numbers on the visa and then you might be able to enter US before new I-797 start date. You have to explain this to the visa officer.
